Terms of Service

Please read these Terms of Service (“Terms”) carefully before engaging Barrie Property Care (“we”, “us”, or “our”) for residential or commercial property care, exterior cleaning, repairs, or seasonal maintenance services, or using our website at https://barriepropertycare.ca.
1. Scope of Services & Estimates
Any online cost ranges, automated calculator results, or initial telephone quotes provided by Barrie Property Care are preliminary, non-binding estimates based on information supplied by the client. Formal binding agreements require an on-site evaluation or written confirmation from our authorized representative detailing the exact scope of work, surface specifications, and pricing.
Work commences only upon mutual written agreement, electronic confirmation, or acceptance of a formal quote order by the property owner or authorized representative.
2. Property Access, Preparation & Utilities
To ensure the safe, efficient, and timely performance of our services, the client agrees to:
- Ensure unobstructed physical access to all service areas (driveways, walkways, rooflines, decks, and building perimeters).
- Provide continuous, uninterrupted access to an operational external water supply (exterior spigot) and, where necessary, standard 120V exterior electrical outlets.
- Ensure all windows and exterior doors are tightly shut, latched, and sealed prior to high-pressure washing or soft washing operations.
- Safely secure all domestic pets indoors for the duration of the technician visit.
- Move sensitive personal items, patio furniture, fragile planters, and motor vehicles away from the immediate work zone prior to technician arrival.
3. Weather Dependencies & Scheduling (Ontario Climate)
Exterior property maintenance in Simcoe County is highly sensitive to Ontario weather conditions. Extreme rainfall, high wind events, lightning, sub-zero freeze-thaw cycles, or heavy snowfalls may necessitate rescheduling for safety and quality assurance.
Barrie Property Care reserves the right to postpone or reschedule service appointments due to hazardous weather or safety concerns without penalty. We will make every reasonable effort to notify the client as early as practicable and reschedule at the earliest viable date.
4. Payment Terms & Invoicing
- Residential Services: Payment is due in full upon completion of the agreed work and client walk-through, unless otherwise agreed in writing.
- Commercial & Seasonal Contracts: Commercial accounts and seasonal service contracts (such as winter snow removal) are billed per the terms specified in their individual service contracts.
- Accepted Payment Methods: Interac e-Transfer, major credit cards, and business cheques where pre-approved.
- Late Charges: Invoices outstanding beyond thirty (30) days are subject to interest at a rate of 2% per month (26.82% per annum), calculated and compounded monthly on the outstanding balance, or the maximum rate permitted by Ontario law.
5. Pre-Existing Conditions & Limitation of Liability
Property maintenance often involves cleaning surfaces that have experienced years of environmental degradation, UV oxidation, biological infestation (algae, mold, lichen), or prior structural movement.
To the maximum extent permitted by Ontario law:
- Pre-Existing Damage: Barrie Property Care is not liable for loose shingles, deteriorated mortar, aged exterior caulking, compromised window seals (fogging), spalled concrete, or sun-faded siding revealed or exacerbated by the removal of masking dirt, moss, or grime.
- Underground & Unmarked Utilities: The client is responsible for marking or notifying our team of any non-standard, shallow, or delicate underground irrigation, lighting, or drainage fixtures before work begins.
- Consequential Damages: Under no circumstances shall Barrie Property Care be liable for indirect, incidental, punitive, or consequential damages resulting from service execution or delays.
- Aggregate Liability Cap: Our total aggregate liability under any circumstances arising out of or related to our services shall be strictly capped at the total amount paid by the client for the specific service in dispute.
6. Satisfaction Guarantee & Defect Notice
We take pride in our workmanship. If any aspect of our completed work does not meet agreed specifications, the client must notify us in writing within forty-eight (48) hours of project completion. Barrie Property Care will promptly inspect the property and, if deemed warranted, re-clean or touch up the disputed area at no additional charge.
7. Cancellation & Rescheduling Policy
Clients may cancel or reschedule a confirmed service appointment without charge by providing at least twenty-four (24) hours notice prior to the scheduled service window. Cancellations made with less than 24 hours notice where technicians have already been mobilized may be subject to a mobilization fee of up to $75.00 CAD to offset travel and staging costs.
8. Website Use & Intellectual Property
All text, branding, code, interactive tools (including the Seasonal Checklist), design layouts, and graphics on this website are the proprietary property of Barrie Property Care or licensed to us. You may not copy, reproduce, scrape, or distribute our content without prior express written consent.
9. Governing Law & Dispute Resolution
These Terms and any agreement for our services shall be governed by, construed, and enforced in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal proceeding arising out of or related to these Terms shall be instituted exclusively in the courts situated in the County of Simcoe, Ontario.
